2. Information We Collect
2.1 Information You Give Us
We collect the information you choose to provide when you fill out a form on the Site, call us, or email us. The Site currently has these forms:
- Contact form ("Send Us a Message," Contact page): the topic of your inquiry (looking for a home, financing question, selling a home, selling a note, or something else), your name, email address, phone number, preferred contact method (phone, email, or either), and your message.
- Financing inquiry form ("Tell Us About Your Situation," Financing page): your name, phone number, email address, the home or property you are interested in, your approximate budget, your preferred monthly payment, and anything else you choose to tell us. This form is a way to start a conversation. It is not a loan or credit application, and submitting it is not an offer or approval of credit.
- Sell your home form ("Request an Offer," Sell Your Home page): your name, phone number, email address, the home's address, year, number of bedrooms and bathrooms, asking price, manufacturer, community or park name, and any additional information you provide.
Please do not include sensitive information such as Social Security numbers, bank account numbers, or credit card numbers in a website form or message. If you move forward with buying a home, a seller-financed purchase, or selling a home or note, we may ask for more information at that stage, such as identification, income and employment information, credit information, title documents, or note and payment-history documents. That information is collected outside the Site and is handled as described in Section 5 (Seller Financing Customers) and in any separate notices or agreements we give you at that time.
2.2 Information Collected Automatically
When you visit the Site, our website platform and the third-party services built into the Site automatically collect some technical information, such as:
- your IP address and approximate location derived from it;
- browser type, device type, and operating system;
- pages you view, links you click, and the date and time of your visit;
- the website or link that referred you to the Site, including campaign (UTM) tags in the link.
This information is collected through cookies, pixels, local storage, and similar technologies. See Section 6 (Cookies and Similar Technologies).
2.3 Information From Other Sources
We may receive information about you from real estate agents we work with, mobile home community (park) managers, people who refer you to us, and, if you apply for seller financing, from credit reporting agencies and others you authorize us to contact. If you apply for financing through an outside lender, such as Vanderbilt Mortgage & Finance, Inc., we may receive information from that lender about the status of your application, whether you were approved, and the terms offered.
3. How We Use Your Information
We use personal information to:
- respond to your inquiries and follow up by your preferred contact method;
- help you find a home that fits your location, budget, size, and timing, and tell you about homes that become available;
- discuss financing options and, if you apply for seller financing on a home CFM Group owns, evaluate your request and service any resulting installment sale contract;
- evaluate a home or mobile home note you want to sell to us and make an offer;
- arrange showings, and connect you with community (park) management or real estate agents when you ask us to;
- operate, maintain, secure, and improve the Site, including preventing spam and fraud on our forms;
- understand how visitors use the Site;
- keep business records and comply with legal, tax, and regulatory obligations; and
- enforce our Terms and Conditions and protect our rights and the rights of others.
Calls and text messages. If you give us your phone number, we may call or text you about your inquiry. We will not send you automated or prerecorded marketing calls or texts without your prior express written consent. Message and data rates may apply. You can tell us to stop contacting you at any time, including by replying STOP to a text message.
We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.
4. How We Share Your Information
We share personal information only as described below:
- Service providers. Companies that help us run the Site and our business, such as our website platform and form-hosting provider (Duda, used by our web developer River City Advertising), email providers, spam-protection services, Intuit Inc. (QuickBooks Online and QuickBooks Payments) for accounting, invoicing, and payment processing. They may use your information only to provide services to us. When you make an online payment through the payment link on the Site, your card or bank account details are collected and processed by Intuit under its own privacy policy. CFM Group does not store full card or bank account numbers.
- People involved in your transaction, at your request. For example, mobile home community (park) management when you apply to live in a community, real estate agents when you ask for help finding land, title or closing service providers, and, for seller financing, credit reporting agencies.
- Outside lenders, at your request. If you ask us to help you apply for financing from an outside lender, we share your information with that lender, primarily Vanderbilt Mortgage & Finance, Inc., to help you apply. The lender's own privacy policy governs how it uses your information.
- Legal and safety reasons. When we believe in good faith that disclosure is required by law, subpoena, or court order, or is needed to protect the rights, property, or safety of CFM Group, our customers, or others.
- Business transfers. If CFM Group is involved in a merger, sale of assets, financing, or similar transaction, personal information may be transferred as part of that transaction, subject to this Privacy Policy.
- With your consent. In any other case where you ask us to or agree that we may.
5. Seller Financing Customers
CFM Group does not operate as a lender through the Site, and the Site does not make offers of credit. On occasion, and subject to approval, CFM Group may offer seller financing (an installment sale with interest) on a home it owns outright. CFM Group does this rarely. If you apply for or obtain seller financing from us, the federal Gramm-Leach-Bliley Act and related rules may apply to the nonpublic personal information we collect about you in connection with that financing. In that case, you will receive a separate privacy notice that explains how we handle that information, and that notice will control for that information if it conflicts with this Privacy Policy. [Jim: Can you confirm whether CFM Group must provide a Gramm-Leach-Bliley privacy notice to financing customers and whether any licensing disclosures (for example, an NMLS number) must appear on the Site?]
6. Cookies and Similar Technologies
Cookies are small text files stored on your device. The Site uses cookies and similar technologies for the purposes below.
- Essential and platform cookies. Our website platform (Duda) uses cookies and local storage to deliver pages, keep the Site secure, and make features such as forms work.
- Analytics. Our website platform collects page-view and usage statistics so we can see how the Site is used. This includes recording the referring website and campaign (UTM) tags from links that bring you to the Site. [Jess & Justin: Can you confirm whether Google Analytics, a Meta (Facebook) Pixel, or any other analytics or advertising tag is installed on the Site. None was found in the Site's code during our review. If one is added, list it here.]
- Spam protection. Our forms may use Google reCAPTCHA to tell people apart from automated bots. reCAPTCHA collects hardware and software information and sends it to Google. Use of reCAPTCHA is subject to Google's Privacy Policy (https://policies.google.com/privacy) and Terms of Service (https://policies.google.com/terms).
- Embedded content. The home page includes an embedded YouTube video and an interactive map provided by Mapbox. When you view a page with embedded content, the provider (YouTube/Google or Mapbox) may set cookies and collect information about your device and how you interact with the content, under its own privacy policy.
Your choices. Most browsers let you block or delete cookies in their settings. If you block cookies, some parts of the Site may not work properly. You can also limit tracking with browser privacy settings or extensions. The Site does not currently respond to "Do Not Track" browser signals, because there is no common industry standard for them. [Jess & Justin: If you turn on the cookie consent banner available in the Duda platform, or start using advertising cookies, update this section and confirm whether you will honor Global Privacy Control signals.]
7. Third-Party Links and Services
The Site links to websites we do not control, including our Facebook page (facebook.com/cfmgroup), our LinkedIn page (linkedin.com/company/cfmgroup), Google Maps directions to our office, our web developer's website, and real estate agents' contact information. This Privacy Policy does not apply to those sites or services. Please review their privacy policies before giving them information.
8. How Long We Keep Information
We keep personal information for as long as we need it for the purposes described in this Privacy Policy. In general:
- inquiries that do not lead to a transaction are kept for two years after our last contact with you;
- records of home sales, purchases, financing, and note purchases are kept for as long as the related agreement is in effect and afterward for as long as required by law, tax, and accounting rules, or as needed to resolve disputes; and
- automatically collected technical data is kept according to our website platform's standard practices.
When we no longer need personal information, we delete it or make it anonymous.
9. How We Protect Information
We use reasonable administrative, technical, and physical safeguards to protect personal information, including sending Site traffic over an encrypted (HTTPS) connection. No website, email, or storage system is completely secure, so we cannot guarantee absolute security. Email sent to us is not encrypted, so please do not email sensitive financial information. If we learn of a security breach that affects your personal information, we will notify you as required by Virginia law and other applicable law.
10. Children's Privacy
The Site is intended for adults. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, please contact us and we will delete it.
11. Your Choices and Rights
All visitors. You may contact us at any time to:
- ask what personal information we have about you;
- ask us to correct or update your information;
- ask us to delete your information, unless we need to keep it for a legal or business reason (for example, records of a completed sale or an active installment sale contract); and
- ask us to stop contacting you.
Virginia and other state privacy laws. Some states, including Virginia (Virginia Consumer Data Protection Act), California (California Consumer Privacy Act, as amended), and others, give residents additional privacy rights. These laws apply only to businesses that meet certain size or data-volume thresholds, and some exempt information covered by the Gramm-Leach-Bliley Act. [Jim: Can you confirm whether any state consumer privacy law applies to CFM Group. If none applies, I will state here: "CFM Group does not currently meet the thresholds for these laws."] Whether or not these laws apply, we will honor reasonable requests to access, correct, or delete your personal information as described above. If a state privacy law does apply to you and to us, you may have the right to:
- confirm whether we process your personal information and access it;
- correct inaccuracies;
- delete personal information;
- get a copy of your personal information in a portable format;
- opt out of the sale of personal information, targeted advertising, and certain profiling (we do not sell personal information or use it for targeted advertising); and
- appeal our decision if we decline your request.
We will not treat you differently for exercising any of these rights.
How to make a request. Email us at Privacy@CFMGroup.us or call 804-262-4005. We may need to verify your identity before we act on your request. If we decline your request, you may appeal by replying to our decision with "Appeal" in the subject line, and we will respond within the time required by law.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the "Last Updated" date above. If we make material changes, we may also post a notice on the Site. Your continued use of the Site after a change is posted means you accept the updated Privacy Policy.
