These Terms and Conditions ("Terms") govern your use of www.cfmgroup.us (the "Site"), which is owned and operated by CFM Group, LLC ("CFM Group," "we," "us," or "our"), 6001 Lakeside Ave., Suite 3, Henrico, VA 23228.

1. Acceptance of These Terms

By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you do not agree, please do not use the Site. You must be at least 18 years old to submit information through the Site.

2. About the Site

The Site provides general information about CFM Group and the services we offer, including:

  • new and pre-owned mobile and manufactured homes for sale in Virginia;
  • general information about financing, including occasional seller financing (installment sales with interest) on homes CFM Group owns outright, offered subject to approval;
  • buying mobile homes from owners and communities; and
  • possibly buying mobile home notes from individuals, investors, and communities, when they meet our criteria.

The Site also lets you contact us, start a financing conversation, and ask us to review a home you want to sell.

3. Home Listings and Information

We try to keep the home listings, prices, photos, sizes, features, lot rents, community details, and availability on the Site accurate and current. However:

  • listings may contain errors or may be out of date, and homes may be sold or withdrawn at any time without notice;
  • prices, lot rents, fees, timelines (such as "move-in ready in as little as 45 days"), and other details are provided for general planning purposes only and may change;
  • photos and floor plans may show representative models, options, or furnishings that are not included;
  • some pre-owned homes are acquired from lenders, including homes that were repossessed, and are sold "as is" unless otherwise stated in a written agreement signed by CFM Group;
  • home descriptions are believed to be accurate but are not guaranteed; and
  • statistics on the Site (such as numbers of lots, models, or clients) are approximate.

Nothing on the Site is an offer to sell, a binding price quote, or a contract. The terms of any purchase, sale, or seller-financed installment sale will be set only in a separate written agreement signed by you and CFM Group. Rules for living in a mobile home community, lot rent, and approval to live in a community are set by that community's management, not by CFM Group. You should inspect any home and confirm all details before you buy.

4. Financing Information

Information on the Site about financing is general and for informational purposes only. The Site does not make offers of credit, and nothing on the Site is a commitment to lend or extend credit. CFM Group is not a bank or mortgage lender. On occasion, CFM Group may offer seller financing (an installment sale with interest) on a home it owns outright. Seller financing is offered rarely, only on homes CFM Group owns, and always subject to approval. Submitting a form on the Site is not a credit application and does not guarantee financing, approval, any rate, payment amount, or term. Availability and terms depend on your individual circumstances, the home, and other factors, and every request is considered on a case-by-case basis. Any seller financing will be governed only by the written installment sale contract and related documents you sign. Our primary outside financing source is Vanderbilt Mortgage & Finance, Inc.. CFM Group is not the lender for loans made by outside lenders. Whether you are approved, and the rate, payment, and other terms of any outside loan, are decided solely by the lender under its own terms and policies. [Jim: Can you confirm whether any lender licensing information, NMLS number, Equal Housing Opportunity statement, or other required financing disclosures must appear on the Site?]

5. Offers to Buy Homes and Notes

If you ask us to review a home or a mobile home note you want to sell, we will review your submission, but we are not obligated to make an offer. Any offer we make is not binding until it is set out in a written agreement signed by both parties. Offers to buy a note are based on a discounted percentage of the remaining cash flow and will not equal the total of the remaining payments. You are under no obligation to accept any offer.

6. Online Payments

Online payments made through the payment link on the Site are processed by Intuit Inc. through QuickBooks Payments, not by CFM Group. Your payment is subject to Intuit's terms of service and privacy policy, in addition to these Terms and any written agreement you have with CFM Group. CFM Group does not store full card or bank account numbers.

7. Your Submissions

When you submit information through the Site, you agree that:

  • the information is true, accurate, and complete to the best of your knowledge;
  • you have the right to provide it, including any information about a home, property, or note;
  • you will not submit sensitive information such as Social Security numbers or bank account numbers through a Site form; and
  • we may use the information to respond to you and as described in our Privacy Policy.

By providing your phone number and email address, you agree that we may contact you by phone, text message, or email about your inquiry.

8. Acceptable Use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • submit false, misleading, or fraudulent information, or impersonate anyone;
  • send spam, junk messages, or unsolicited advertising through the Site's forms;
  • interfere with, disrupt, or try to gain unauthorized access to the Site, its servers, or connected systems;
  • upload or transmit viruses, malware, or other harmful code;
  • use robots, scrapers, or other automated tools to copy or collect content or data from the Site without our written permission; or
  • copy, reproduce, or republish Site content, including home listings and photos, except as allowed in Section 9.

We may suspend or block access to the Site for anyone who violates these Terms.

9. Intellectual Property

The Site and its content, including text, home listings, photos, videos, graphics, logos, the CFM Group name, and the design and layout of the Site, are owned by CFM Group or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages from the Site for your personal, non-commercial use, such as considering a home purchase. You may share links to Site pages. Any other use, including copying, modifying, distributing, or using our content or marks for commercial purposes, requires our prior written permission.

10. Third-Party Links and Content

The Site contains links to and content from third parties, including our Facebook and LinkedIn pages, Google Maps, embedded YouTube videos, an embedded map, our web developer's website, and contact information for independent real estate agents. These third parties are not under our control. We are not responsible for their content, products, services, or privacy practices, and a link does not mean we endorse them. Real estate agents listed on the Site are independent professionals, not employees or agents of CFM Group, and any services they provide are between you and them. Your use of third-party sites and services is at your own risk and subject to their terms.

11. Disclaimers

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, CFM GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

Content on the Site is general information. It is not financial, legal, tax, or real estate advice. Please consult a qualified professional about your situation.

This section applies to your use of the Site only. Any warranties on a home you buy from us are only those stated in your written purchase agreement or provided by the manufacturer or by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CFM GROUP AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). [Jim: Can you confirm the liability cap amount?]

Some states do not allow certain limitations of liability, so some of these limits may not apply to you. This section does not limit liability that cannot be limited by law, and it does not change the terms of any separate written agreement between you and CFM Group.

13. Indemnification

You agree to defend, indemnify, and hold harmless CFM Group and its owners, members, managers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your misuse of the Site, (b) your violation of these Terms, or (c) any information you submit that is false or that violates someone else's rights.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Site will be brought only in the state or federal courts located in Henrico County, Virginia, or the Eastern District of Virginia, and you consent to the jurisdiction of those courts. 15. Changes to the Site and These Terms

We may change, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will post the updated Terms on this page and change the "Last Updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms.

16. General

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later. These Terms, together with our Privacy Policy, are the entire agreement between you and CFM Group about your use of the Site. They do not replace any separate written agreement you sign with us for the purchase or sale of a home or note, including any seller-financed installment sale contract.
